These Terms & Conditions apply to bookings made through Damp-Proofing.net for damp inspections and related appointment arrangement services.

1. About These Terms

These Terms & Conditions govern the use of Damp-Proofing.net and the booking of damp inspection services through the website.

By making a booking, submitting payment or requesting that an inspection is arranged, you agree to these Terms & Conditions.

2. Our Service

Damp-Proofing.net provides an inspection booking and contractor matching service. We arrange for a damp proofing contractor covering your area to attend your property and assess the reported damp, mould, condensation or moisture problem.

Unless expressly stated otherwise in writing, Damp-Proofing.net does not itself carry out subsequent damp proofing, building, plastering, rendering, drainage, roofing, ventilation or other remedial works.

Any subsequent remedial work is normally quoted for and carried out separately by the appointed contractor.

3. Independent Contractors

Contractors introduced or appointed through Damp-Proofing.net may operate as independent businesses and are not necessarily employees, workers, agents or partners of Damp-Proofing.net.

Any quotation, contract, warranty, guarantee or agreement for subsequent remedial work will normally be between you and the contractor carrying out that work unless expressly stated otherwise.

The contractor is responsible for the scope, price, suitability, quality, safety and performance of any remedial work they agree to carry out for you.

4. Contractor Vetting

Where we describe contractors as vetted, this means we have applied our contractor acceptance process at the time they joined or were reviewed by our network.

Vetting may include checks relating to business identity, experience, insurance, references, reviews, qualifications or other information we consider relevant.

Vetting does not amount to a guarantee that a contractor will be suitable for every property, that a particular diagnosis will be correct, or that any later remedial work will be free from defects.

5. The £120 Inspection Fee

The standard damp inspection fee is £120 unless a different price is clearly stated before booking.

The £120 fee is payment for the inspection booking and inspection service. It is not a deposit on future damp proofing work.

Any remedial work recommended following the inspection is quoted separately.

6. £120 Credit Against Remedial Work

If remedial work is recommended and you choose to proceed with that work through the appointed contractor, an amount equal to the £120 inspection fee may be credited against the agreed cost of the remedial work, subject to these Terms and the contractor's participation in the credit arrangement.

The credit does not mean that Damp-Proofing.net is a party to the subsequent remedial-work contract.

The credit has no cash value and is not payable as cash where the customer chooses not to proceed with remedial work.

7. Quotations for Remedial Work

Damp-Proofing.net does not guarantee the price of remedial work before the property has been inspected.

The contractor may provide a quotation after assessing the property. The amount of that quotation will depend on matters including the nature of the problem, property construction, affected area, access, materials and work required.

You are under no obligation to accept a contractor's quotation.

Declining a quotation, considering a quotation too expensive, or choosing to obtain alternative quotations does not by itself create a right to a refund of a properly completed inspection fee.

8. No Guarantee of Diagnosis or Remedial Outcome

A damp inspection is an assessment based on the condition of the property and information reasonably available at the time of the visit.

Some moisture problems may be concealed, intermittent, weather dependent or caused by defects that cannot reasonably be identified during a normal visual or non-invasive inspection.

Unless expressly agreed otherwise in writing, no guarantee is made that an inspection will identify every defect or future moisture problem within the property.

9. Access to the Property

You are responsible for ensuring that the contractor has reasonable and safe access to the property and to the areas requiring inspection.

Furniture, stored items, locked rooms, floor coverings, wall coverings or other obstructions may limit the inspection.

You should tell us or the appointed contractor in advance about any known hazards, restricted access or other circumstances that may affect attendance.

10. Appointments and Attendance

Appointment dates and times are arranged in good faith but may occasionally need to be changed because of illness, traffic, weather, contractor availability, emergencies or other circumstances outside reasonable control.

Where an appointment needs to be rearranged, we will make reasonable efforts to arrange an alternative appointment.

11. Customer Cancellations

If you wish to cancel an inspection, you should contact us as soon as possible.

Your statutory cancellation rights are not affected by these Terms. Where applicable, online service contracts may carry a 14-day cancellation period.

If you specifically request that the inspection service begins during the statutory cancellation period, you may be required to pay for the proportion of the service already supplied before cancellation. Where the service has been fully performed after your express request and the legally required acknowledgement has been given, your cancellation right may end once the service has been fully performed.

12. Refunds

Refunds will be provided where required by law.

Subject to your statutory rights, a refund would not normally be due solely because:

  • you decide not to proceed with remedial work;
  • you do not accept the contractor's quotation;
  • you consider the quotation too expensive;
  • you choose another contractor after the inspection;
  • no remedial work is ultimately required;
  • the problem differs from what you originally expected.

Where an inspection cannot be supplied through no fault of the customer, we may offer an alternative appointment or refund as appropriate.

Nothing in these Terms excludes any refund, repeat performance, price reduction or other remedy to which you are legally entitled.

13. Missed Appointments

If a contractor attends at the agreed time but cannot gain access to the property because nobody is present or access has not been made available, the inspection may be treated as a missed appointment.

We may charge a reasonable amount reflecting costs or losses actually incurred as a result of a customer cancellation or missed appointment, where permitted by law.

14. Contractor Quotations and Work

Damp-Proofing.net is not responsible for determining or controlling the contractor's quotation for subsequent remedial work unless expressly agreed otherwise.

You should review the contractor's quotation, scope of works, payment terms, warranties, guarantees and other conditions before agreeing to remedial work.

Any dispute concerning subsequent work should normally be raised directly with the contractor that supplied or carried out that work.

15. Liability

Nothing in these Terms excludes or restricts liability where it would be unlawful to do so.

In particular, nothing in these Terms excludes your statutory consumer rights or any liability that cannot legally be excluded.

Subject to those rights and to the fullest extent permitted by law, Damp-Proofing.net will not be responsible for losses arising solely from a separate contract entered into directly between you and an independent contractor for subsequent remedial work.

Subject to applicable law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable when the inspection service was booked.

16. Damage Caused During Subsequent Work

Where a customer separately contracts with an independent contractor for remedial work, responsibility for workmanship, property damage, materials, health and safety, warranties and completion of that work normally rests with that contractor under the separate contract.

Customers should raise workmanship or damage complaints directly with the contractor in the first instance.

17. Customer Information

You agree to provide accurate contact, property and booking information.

We are not responsible for delays or failed appointments caused by incorrect addresses, telephone numbers, email addresses or other information supplied by the customer.

18. Photographs and Property Information

You may provide photographs, descriptions or other information about the property to help us arrange the inspection.

Such information may be shared with the appointed contractor where reasonably necessary for the inspection or appointment.

19. Personal Data

Personal information is handled in accordance with our Privacy Policy and applicable data protection law.

By booking an inspection, you understand that relevant contact and property information may need to be provided to the appointed contractor so that they can contact you and attend the property.

20. Complaints

If you are unhappy with the inspection booking service, please contact us promptly so that we have an opportunity to investigate and, where appropriate, put matters right.

Where a complaint concerns subsequent remedial work carried out under a separate contract, the complaint should normally be raised with the contractor responsible for that work.

21. Website Information

Information on Damp-Proofing.net is provided for general information and marketing purposes and should not be treated as a substitute for an onsite property assessment.

Damp and moisture symptoms can have multiple possible causes. Information provided on the website does not amount to a guaranteed diagnosis of a particular property.

22. Events Outside Our Reasonable Control

We will not be responsible for delays or failure caused by events outside our reasonable control, including severe weather, transport disruption, illness, emergencies, contractor availability, telecommunications failures or similar circumstances.

23. Changes to These Terms

We may update these Terms & Conditions from time to time. The terms applying to your booking will normally be those made available to you when the booking was placed.

24. Governing Law

These Terms are governed by the applicable laws of the United Kingdom.

Nothing in this clause removes any mandatory consumer rights you have regarding the courts or law applicable where you live.
